Terms of Service

These Terms of Service ("Terms") govern your use of the Beacon Safe mobile application ("Beacon") and related services (the "Service") operated by Copperline Labs LLC ("we," "our," or "us"). By using the Service, you agree to these Terms.
Important Safety Notice
BEACON SAFE IS NOT AN EMERGENCY SERVICE AND IS NOT A SUBSTITUTE FOR CALLING EMERGENCY SERVICES. This app notifies your personal emergency contacts when you miss a check-in — it does NOT contact 911, police, fire departments, medical services, or any emergency responders.
IN ANY LIFE-THREATENING EMERGENCY, YOU MUST CALL 911 (IN THE UNITED STATES) OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY. DO NOT RELY ON THIS APP IN PLACE OF EMERGENCY SERVICES.
You acknowledge and agree that:
- Alert delivery depends on network availability, carrier service, and recipient device status, and cannot be guaranteed.
- Your emergency contacts may not receive, see, or respond to alerts.
- SMS and voice call delivery is subject to carrier limitations, network congestion, and third-party service availability.
- The Service may experience downtime, interruptions, or delays.
- Copperline Labs LLC bears no responsibility for the actions or inactions of your emergency contacts.
- This app is a supplemental check-in tool and should be used as part of a broader personal safety plan, not as your sole means of emergency communication.
1. Service Description
Beacon Safe is a personal safety check-in application. You set a check-in timer before an activity, and if you do not check back in before the timer expires, Beacon automatically sends safety alert notifications to your designated emergency contacts via SMS, email, and/or voice call depending on your subscription tier.
Beacon is a communication tool and is not a substitute for emergency services. In an emergency, always contact local emergency services (e.g., 911 in the United States) directly.
2. Eligibility
You must be at least 13 years old to use Beacon. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
3. Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials.
- All activity that occurs under your account.
- Providing accurate and current contact information for yourself and your emergency contacts.
- Obtaining consent from individuals before adding them as emergency contacts.
- Ensuring your emergency contacts are aware they may receive safety alert notifications from Beacon on your behalf.
4. Subscriptions and Payments
Beacon offers a free tier and a paid subscription tier ("Beacon Plus"). Subscriptions are managed through the Apple App Store or Google Play Store, and are subject to their respective terms and refund policies.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage and cancel your subscription through your device's app store settings.
- Pricing may change with reasonable notice. Existing subscribers will be notified before any price increase takes effect on their account.
5. Acceptable Use
You agree not to use Beacon to:
- Send false, misleading, or fraudulent safety alerts.
- Harass, threaten, or abuse any person, including your emergency contacts.
- Violate any applicable law or regulation.
- Interfere with or disrupt the Service or its infrastructure.
- Attempt to gain unauthorized access to any part of the Service.
- Use the Service for any purpose other than personal safety check-ins.
We reserve the right to suspend or terminate your account if you violate these Terms or use the Service in a manner we reasonably determine to be harmful or abusive.
6. SMS and Messaging Terms
Beacon delivers safety alert notifications via SMS (text message), email, and voice call. SMS messaging is governed by our separate SMS Alert Terms, which cover consent, message frequency, opt-out instructions, and related disclosures. By enabling SMS alerts in the Beacon app, you acknowledge and agree to those terms separately.
SMS carriers may filter or delay messages. Copperline Labs is not responsible for message delivery failures caused by carrier filtering, network outages, or device issues. For questions about alert delivery, contact support@beaconsafe.app.
Voice Alert Terms (Plus Tier): Voice alerts are automated calls delivered via Twilio. Calls are not recorded. Emergency contacts who receive voice calls can request removal by contacting support@beaconsafe.app. Voice calls may include interactive prompts (press 1, press 2) to acknowledge alerts. Standard carrier charges may apply. Voice delivery depends on carrier availability and cannot be guaranteed.
7. Service Availability
We strive to provide a reliable service, but we do not guarantee uninterrupted availability. Beacon depends on third-party services (including SMS carriers, email providers, and voice call networks) that are outside our control. We are not liable for delays or failures in alert delivery caused by third-party service disruptions, network outages, or device issues.
After extended periods without a check-in, Beacon may inform your emergency contacts of the duration. Any decisions your contacts make — including whether to request a welfare check from local authorities — are made solely at their own discretion. Beacon does not direct, recommend, or facilitate contact with law enforcement or emergency services. Copperline Labs LLC bears no responsibility for the outcomes of actions taken by your emergency contacts.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Copperline Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use of or inability to use the Service.
- Any failure or delay in the delivery of safety alert notifications.
- Any unauthorized access to or alteration of your data.
- Any conduct or content of any third party related to the Service.
Beacon is a supplementary safety tool, not a guaranteed emergency response system. You acknowledge that the Service may not function in all circumstances and should not be your sole safety plan.
IN NO EVENT SHALL THE TOTAL LIABILITY OF COPPERLINE LABS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Indemnification
You agree to indemnify and hold harmless Copperline Labs LLC, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.
11. Termination
You may stop using Beacon and delete your account at any time through the app settings. We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice, except in cases of severe or repeated violations where immediate action is necessary.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and governing law) will survive.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app or sending you an email at least 14 days before the changes take effect. Your continued use of Beacon after the effective date of revised Terms constitutes your acceptance of the changes.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Sheridan County, Wyoming.
